TERMS OF SERVICE

These Terms of Service ("Terms") govern all sales made on the MOWA website, accessible at eanc4y-g1.myshopify.com (the "Site"), operated by MOWA (the "Seller").

By placing an order on the Site, you agree to be bound by these Terms without reservation.

1. PURPOSE

These Terms define the rights and obligations of the Seller and the buyer ("Customer") in connection with the sale of digital products (high-resolution desktop and iPhone wallpapers, referred to as "Volumes") offered on the Site.

2. PRODUCTS

2.1 Description

Volumes are collections of high-resolution digital wallpapers (5504 x 3072 pixels for desktop). Each Volume includes desktop and iPhone versions of the artwork. Files are delivered in ZIP format.

2.2 Available Offers

- Single Volume: one Volume of your choice
- 3-Volume Bundle: any three Volumes of your choice (discount applied automatically at checkout)
- Full Library: all available Volumes, plus any future Volumes released

Prices are listed in US Dollars (USD). The Seller reserves the right to modify prices at any time, without affecting orders that have already been confirmed.

3. ORDERING

3.1 Order Process

The Customer selects the desired Volumes, adds them to their cart, reviews the order summary, and proceeds to payment. The order is confirmed by an email containing the download link.

3.2 Validation

The Seller reserves the right to refuse or cancel any order in the event of:
- Suspected fraud
- Incorrect information provided by the Customer
- An ongoing dispute with the Customer

4. PRICING AND PAYMENT

4.1 Pricing

Prices displayed on the Site are in US Dollars (USD). Discounts (3-Volume bundle) are applied automatically at checkout, with no promotional code required.

4.2 Payment Methods

Payment is made online at the time of ordering through the following methods:
- Credit/debit card (Visa, Mastercard, American Express) via Shopify Payments
- PayPal
- Any other payment method offered on the Site

Payment is secured by SSL/TLS encryption.

5. DELIVERY

5.1 Digital Products

Volumes are digital products delivered by instant download. Upon payment confirmation:
- An email containing your download link(s) is automatically sent to the email address provided during purchase
- Download link(s) are also available on the order confirmation page

5.2 Availability

Download links remain accessible for a reasonable period. In the event of a technical issue, the Customer may contact the Seller to obtain a new link.

6. LICENSE OF USE

6.1 License Granted

The purchase of a Volume grants the Customer a personal, non-exclusive, non-transferable, and perpetual license to use the files for strictly personal use.

6.2 Permitted Uses

- Using the files as wallpapers on personal devices (computer, phone, tablet)
- Storing the files on personal devices

6.3 Prohibited Uses

The Customer is strictly prohibited from:
- Reselling, distributing, sharing, or making the files available to third parties, whether for free or for a fee
- Using the files for commercial purposes
- Modifying the files for resale or distribution
- Reproducing the files in a public or commercial context
- Incorporating the files into another product intended for sale

Any violation of these terms may result in the immediate termination of the license without refund, as well as legal action.

7. RIGHT OF WITHDRAWAL

Because all products are digital downloads delivered instantly upon purchase, all sales are final. By placing an order and accessing the file downloads, the Customer expressly acknowledges and agrees that no refund or withdrawal is available.

8. INTELLECTUAL PROPERTY

All content on the Site (text, images, visuals, logo, wallpapers) is protected by copyright and intellectual property law. They remain the exclusive property of the Seller or its rights holders.

The purchase of a Volume does not confer any intellectual property rights over the visuals. Only a personal use license is granted in accordance with Section 6 of these Terms.

9. LIABILITY

9.1 The Seller undertakes to provide files that match the description on the Site.

9.2 The Seller shall not be held liable for:
- Incompatibility of the files with the Customer's equipment
- Any damage resulting from improper use of the files
- Inability to download files due to the Customer's internet connection

9.3 In the event of a defective or corrupted file, the Seller will provide a new download link as soon as possible.

10. PERSONAL DATA

The processing of personal data is described in our Privacy Policy, accessible on the Site. By placing an order, the Customer acknowledges having read this policy.

The Seller will respond within 48 business hours.

12. GOVERNING LAW

These Terms are governed by applicable law. Any dispute relating to their interpretation or execution shall be subject to the jurisdiction of the competent courts.
